Job Description

Northern Arizona University's Office for the Resolution of Sexual Misconduct (ORSM): Title IX Institutional Compliance, Prevention & Response ensures NAU's compliance with Title IX related federal and state laws. The ORSM investigates formal complaints of sex/gender-based misconduct under NAU's Sexual Misconduct Policy, provides informal resolution options for certain concerns, offers/helps implement supportive measures and interim actions, and provides consultation and training services for campus partners. The ORSM seeks a skilled, experienced, and motivated Complaint Resolution Officer (CRO) to add to its vibrant team. Reporting to the Title IX Coordinator, the CRO helps prevent and eliminate incidents of sexual harassment and other forms of sexual misconduct, including sexual assault, dating violence, domestic violence, stalking, and related retaliation. This role addresses matters relating to faculty, staff, students, university affiliates, and campus visitors. The CRO develops, implements, and monitors university Title IX compliance to promote nondiscriminatory practices, ensure compliance with federal, state and local law and governmental agency regulations.

The CRO educates the campus community about the university's policies on sexual misconduct and sex/gender-based harassment and advises these constituents about the procedures to file a complaint and about the grievance and adjudication processes. The Complaint Resolution Officer addresses allegations of potential policy violations and tailors specific resolutions to the unique facts and circumstances of an incident.

The CRO independently uses expertise to conduct thorough, impartial formal investigations of allegations covered by federal and other laws, including sexual harassment, sexual assault, and other forms of sex/gender-based discrimination or misconduct. The position independently gathers relevant facts and evidence related to reported incidents/complaints and applies law and policy to the facts to prepare written reports and/or recommended resolutions. The CRO applies broad knowledge of concepts and procedures to perform complex tasks, identifies problems and solutions independently, identifies and resolves missing information, and improves existing processes.

The CRO independently assesses needs of reporting or other parties to refer to appropriate support services and/or notify university officials of possible health or safety matters.

The CRO independently facilitates Informal Resolution of sexual misconduct and other civil-rights based issues using ethical and best practices in the field. The position serves as a point of contact for those seeking information about sexual misconduct or wanting to report sex/gender-based discrimination or misconduct.

The CRO habitually works collaboratively with numerous on and off-campus resources, including, but not limited to, Victim Witness Services, Office of the Dean of Students, Housing and Residential Life, NAU Police Department, Student Assistance Office, Office of General Counsel, Office of Inclusion (IMQ), NAU Counseling Services, Disability Resources, Human Resources, Faculty Ombuds Office, Office of the Provost, Flagstaff Police Department, and Health Promotions.

Title IX Institutional Compliance - 35%
  • Engage in and advance the university's Title IX compliance efforts in various settings, including, but not limited to, monitoring local, state, and federal policies to ensure university compliance, creating educational presentations, designing compliance trainings, and providing consultations with various campus employees across multiple departments.
  • In collaboration with the Title IX Coordinator and Deputy Title IX Coordinators, helps promote gender equity across NAU's various campus locations.
  • Determines the effectiveness of university sexual misconduct policies and recommends actions to promote greater compliance.

Formal Grievance Investigation - 30%
  • Independently investigates formal grievances of sexual misconduct relating to students, faculty, staff, alumni, and other NAU-affiliates, analyses evidence in light of the facts, policy, and legal principles.
  • Recommends the disposition of formal complaints/grievances.
  • Investigates and/or consults on certain issues and formal grievances related to sex/gender-based discrimination where the allegations intersect under Title IX and Title VII.

Informal Grievance Resolution - 30%
  • Using discretion and independent judgment, informally resolves sex/gender-based matters relating to students, faculty, staff, alumni, and other NAU-affiliates using various dispute resolution techniques and processes, including, but not limited to, the Informal Resolution Process.
  • Meets with faculty, staff, or students involved with grievances to counsel and settle disputes.

  • Perform other duties as assigned.


Minimum Qualifications

  • Bachelor's degree and extensive training in the area of discrimination and harassment law, including civil rights laws such as Title IX, Title VI, and Title VII or any combination of relevant education and experience may be substituted for the educational requirement on a year-for-year basis.
  • 5-7 years of relevant experience in higher education or a legal setting.
  • Teaching or training experience.


Preferred Qualifications

  • J.D. or other relevant advanced degree (e.g., legal studies, dispute resolution, ethics and compliance, psychology).
  • 6-8 years of relevant experience in the higher education context.
  • Teaching or training experience in protected class discrimination and harassment and employment law or in a higher education context.
  • ATIXA Investigator Certification.
  • 40+ hours of Mediation Training approved by a state/court system.

Background Information

This position has been identified as a safety/security sensitive position. Therefore, per AZ Revised Statute, Northern Arizona University requires satisfactory results for the following: a criminal background investigation, employment history investigation, degree verification (in some cases) and fingerprinting. In addition, the Fire Safety Report is combined with the Annual Security Report for the NAU Flagstaff Mountain Campus as this campus has on-campus student housing. This report discloses fire safety policies and procedures related to on-campus student housing and statistics for fires that occurred in those facilities. Salary

Salary range begins at $82,000. Annual salary commensurate with candidate's qualifications and related experience.

FLSA Status

This position is exempt from the overtime provisions of the Fair Labor Standards Act (FLSA) and therefore will not earn overtime or compensatory time for additional time worked.

Benefits

This is a Service Professional (SPF) position. NAU offers an excellent benefit package including generous health, dental and vision insurance; participation in the Arizona State Retirement System or the Optional Retirement Program; 22 days of vacation and 10 holidays per year; and tuition reduction for employees and qualified dependents. Service Professionals are hired on a contract basis, renewable each 6 months according to terms of the Conditions of Professional Service. Employees offered a position will be eligible for state health plans (including NAU's BCBS Plan). Employees will have 31 days from their start date to enroll in benefits. If a new employee chooses the ASRS retirement option, participation in the Arizona State Retirement System, and the long-term disability coverage that accompanies it, will begin on the first of the pay period following 6 months after the new employee's start date. New employees who choose to participate in the Optional Retirement Plan (ORP), which is an alternative to the ASRS plan for faculty and other appointed staff, will begin to participate on the first day of employment. Additionally, the long-term disability plan that accompanies the ORP will begin on the first day of employment.
